These terms should be read in the context of the current product boundary: the mobile app creates secrets, and the website primarily presents public pages and browser-based opening routes.

1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of the Anomonus website, mobile applications, web viewer, APIs, encrypted secret-sharing features, QR-linked content, ticketed access flows, RSVP flows, device-binding features, related content tools, and all related services, software, and functionality provided by ANOMONUS - FZCO (“Anomonus,” “we,” “us,” or “our”) (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and “you” includes that organization.

2. Eligibility
You must be at least 18 years old and legally permitted to use the Service under applicable law.
You must not use the Service if:
• your use would violate applicable law, regulation, sanctions, or court order;
• you are barred from receiving or using the Service under applicable law;
• you are under 18 years of age.
If you are a parent, guardian, company owner, or administrator allowing another person to use the Service through your device, environment, or account context, you are responsible for ensuring lawful use.

3. Nature of the Service
Anomonus provides privacy-oriented functionality designed to let users create, protect, send, share, access, or view encrypted or access-controlled content, including secret messages, secret links, secret locations, secret posts, secret event or party content, and related protected materials.
The Service may include features such as:
• client-side encrypted secret creation,
• link- or QR-based access flows,
• password, ticket, or challenge-controlled access,
• expiration and maximum-view controls,
• burn-after-read style flows,
• device-binding restrictions,
• RSVP and gated-viewing features,
• web and mobile viewing flows,
• transport-protection and abuse-mitigation mechanisms.
Service features may change over time. We may add, remove, suspend, restrict, test, or modify features at any time.

4. No Guarantee of Absolute Anonymity, Secrecy, or Deletion
The Service is designed to reduce unnecessary exposure of sensitive content, but you agree that Anomonus does not guarantee:
• absolute anonymity,
• complete invisibility,
• perfect confidentiality,
• perfect metadata protection,
• guaranteed non-attribution,
• irreversible deletion in all environments,
• complete prevention of copying, recording, photographing, forwarding, or exfiltration by recipients or third parties,
• uninterrupted or error-free operation,
• immunity from compromise, abuse, or lawful access demands.
Even where the Service uses encryption or privacy-enhancing design, security outcomes depend on factors outside our control, including device security, user choices, recipient behavior, hosting infrastructure, operating system behavior, browser behavior, network conditions, and third-party components.
You use the Service at your own risk.

5. Your Responsibilities
You are solely responsible for:
• the content you create, upload, share, access, transmit, or make available through the Service;
• choosing appropriate expiration, access, password, or device-restriction settings;
• keeping any secret URLs, keys, passwords, tickets, or access codes secure;
• ensuring that your use of the Service complies with all applicable laws and rights of others;
• ensuring that recipients are persons to whom you lawfully intend to disclose content;
• maintaining the security of your own devices, browsers, apps, and local storage;
• reviewing the consequences of sharing content through links, QR codes, or other access mechanisms.
If you lose access data, recovery may be impossible in some circumstances.

6. Prohibited Uses
You must not use the Service to:
• violate any applicable law or regulation;
• harass, stalk, threaten, abuse, or exploit any person;
• distribute unlawful, fraudulent, deceptive, defamatory, invasive, or harmful content;
• share content involving child sexual abuse material, unlawful sexual exploitation, or any content involving minors in violation of law;
• distribute malware, spyware, phishing material, credential theft tools, or malicious code;
• facilitate fraud, extortion, blackmail, impersonation, or identity theft;
• store or distribute content that infringes intellectual property, privacy, publicity, confidentiality, or other rights;
• interfere with, disrupt, damage, or overload the Service;
• attempt to bypass access controls, rate limits, anti-abuse mechanisms, or security protections;
• probe, scan, reverse engineer, scrape, or test the Service in an unauthorized manner;
• use bots, scripts, automation, or mass requests in a way that harms the Service or other users;
• use the Service in connection with unlawful surveillance, targeted abuse, illegal marketplace activity, or violent wrongdoing;
• misrepresent your relationship with Anomonus or imply endorsement by us.
We may determine, acting reasonably and in accordance with applicable law, whether conduct is abusive, harmful, unlawful, or otherwise violates these Terms.

7. Sensitive and High-Risk Use
The Service is not designed, licensed, or guaranteed for high-risk use cases where failure, delay, interception, leakage, inaccuracy, or unavailability could lead to death, bodily injury, medical harm, legal prejudice, severe financial damage, or other high-stakes consequences.
You must not rely on the Service as your sole mechanism for:
• emergency communications,
• medical or mental health crisis communications,
• law enforcement or national security operations,
• classified information handling,
• regulated professional secrecy where specific certified infrastructure is legally required,
• legal deadline-critical service where failure of access could materially prejudice rights.

8. User Content
As between you and Anomonus, you retain whatever rights you may have in content you lawfully create or submit to the Service (“User Content”).
However, by using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, store, cache, reproduce, adapt, format, display, and otherwise use User Content solely as reasonably necessary to operate, secure, maintain, provide, protect, investigate, improve, and enforce the Service and these Terms.
This license is limited by the technical architecture of the Service and does not transfer ownership of your User Content to us.
You represent and warrant that:
• you have all rights necessary to submit and share the User Content;
• your User Content and use of the Service do not violate law or third-party rights;
• you will not use the Service to distribute content that you have no right to disclose.

9. Access Controls, Secret Links, Tickets, and Device Restrictions
The Service may use technical restrictions such as secret URLs, QR flows, passwords, keys, tickets, challenge-response systems, recipient restrictions, or device-binding controls.
You acknowledge and agree that:
• access controls reduce risk but do not eliminate it;
• anyone obtaining the required access material may be able to access the content, subject to configured restrictions;
• recipient-side devices, cameras, overlays, secondary devices, browser tools, screen recording tools, or photographs may still defeat intended confidentiality in some situations;
• the effectiveness of device-binding or similar restrictions may vary across devices, app versions, browsers, and operating systems;
• expiration and burn-style features may not guarantee elimination of every cached, copied, logged, mirrored, or previously captured instance.

10. Service Availability and Modifications
Subject to applicable law, we may at any time and without liability:
• modify, suspend, restrict, or discontinue any part of the Service;
• change supported features, limits, design, cryptographic flows, or technical requirements;
• introduce access restrictions, quotas, or rate limits;
• remove content or disable access where we believe necessary for legal, security, operational, or abuse-prevention reasons;
• migrate infrastructure, storage behavior, routing behavior, or technical integrations.
We do not guarantee that the Service or any feature will remain available, compatible, or unchanged.

11. Security and Abuse Prevention
To protect the Service and its users, we may implement and enforce measures such as:
• rate limiting,
• challenge-response systems,
• ticket validation,
• device binding,
• anti-abuse filtering,
• operational logging,
• fraud detection,
• request validation,
• content access controls,
• temporary restrictions or blocking.
You must not attempt to evade these controls.
We may investigate misuse and cooperate with lawful requests and enforcement where required or reasonably necessary to protect rights, safety, systems, users, or the Service.

12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we process information in connection with the Service. By using the Service, you acknowledge that such processing may occur in accordance with the Privacy Policy.
If these Terms and the Privacy Policy appear inconsistent, they should be interpreted together to the maximum extent possible, with the Privacy Policy governing information-processing disclosures and these Terms governing contractual use rules.

13. Intellectual Property Rights
The Service, including its software, design, branding, text, graphics, interfaces, workflows, logos, source materials, and all related intellectual property, is owned by or licensed to Anomonus and is protected by applicable intellectual property laws.
Except as expressly allowed by these Terms or applicable law, you must not:
• copy, modify, reproduce, distribute, sell, sublicense, or create derivative works from the Service;
• reverse engineer or attempt to derive source code, underlying ideas, or non-public technical architecture;
• remove or alter proprietary notices;
• use our branding, logos, trade dress, or product names without prior written permission.
Nothing in these Terms grants you any ownership right in the Service.

14. Feedback
If you provide suggestions, ideas, improvements, bug reports, comments, or other feedback regarding the Service, you grant Anomonus a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, adapt, publish, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you.

15. Third-Party Services and Components
The Service may interoperate with or depend on third-party infrastructure, libraries, transport tools, mapping providers, app stores, hosting platforms, or open-source components.
We do not control all third-party services and are not responsible for:
• third-party outages,
• third-party data practices,
• third-party terms,
• external websites or services linked from the Service,
• failures caused by app stores, hosting providers, browsers, device vendors, or network operators.
Your use of third-party services may be subject to their own terms and policies.

16. Suspension and Termination
We may suspend, restrict, disable, remove, or terminate your access to all or part of the Service at any time, with or without notice, if we believe:
• you violated these Terms;
• your use creates risk for users, third parties, or the Service;
• your use may be unlawful;
• suspension is necessary for security, abuse prevention, investigation, maintenance, or legal compliance;
• continued access is no longer commercially, technically, or operationally feasible.
You may stop using the Service at any time.
Termination or suspension may result in loss of access to content, links, settings, tickets, or related materials. To the extent permitted by law, we are not liable for such loss.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANOMONUS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, PRIVATE, ANONYMOUS, OR FULLY SECURE.
We do not warrant that:
• secrets will only be accessed by intended recipients;
• content will never be copied, captured, or redistributed;
• deletion, expiration, or burn-style logic will eliminate all copies in all systems;
• metadata exposure will be fully prevented;
• routing protections will always function as intended;
• any specific cryptographic or privacy outcome will always be achieved.
Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANOMONUS, ITS AFFILIATES, FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, CONTENT, OR SECURITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ANOMONUS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:
• THE AMOUNT YOU PAID TO ANOMONUS FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• ONE HUNDRED U.S. DOLLARS (USD $100).
These limitations apply regardless of the theory of liability, including contract, tort, negligence, strict liability, or otherwise, to the extent permitted by law.
Some jurisdictions do not permit certain liability limitations, so parts of this section may not apply to you.

19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Anomonus, its affiliates, founders, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
• your User Content;
• your misuse of the Service;
• your violation of these Terms;
• your violation of law or third-party rights;
• disputes between you and any recipient, sender, creator, viewer, or third party connected to content shared through the Service.

20. Export Control and Sanctions
You may not use, access, export, re-export, provide, or transfer the Service in violation of applicable export control, sanctions, or trade laws.
You represent and warrant that you are not located in, ordinarily resident in, or using the Service for the benefit of any person or entity restricted under applicable sanctions or export control laws, to the extent such laws apply to the Service or to you.

21. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the applicable laws and regulations of the Emirate of Dubai, without regard to conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, unless applicable law requires otherwise.

We may update these Terms from time to time. The updated version will become effective when posted, unless a different effective date is stated.
If changes are material, we may provide additional notice where required by law. By continuing to use the Service after the updated Terms become effective, you agree to the revised Terms to the extent permitted by law.
If you do not agree to the revised Terms, you must stop using the Service.

23. General Terms
Entire Agreement
These Terms, together with the Privacy Policy and any additional terms validly incorporated by reference, form the entire agreement between you and Anomonus regarding the Service.
Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
No Waiver
Failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, asset sale, or by operation of law.
Survival
Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, dispute resolution, and enforcement.
